How Australia is Cracking Down on X for Child Abuse Content:
Australia has recently imposed a hefty fine on X, the social media platform formerly known as Twitter, for failing to cooperate with an inquiry into online child abuse content. The fine, which amounts to $600,000 per day, is the first of its kind in the world and reflects the growing concern over the spread of harmful and illegal material on the internet.
X, which rebranded itself in 2022 after a series of scandals and controversies, has been accused of not providing adequate information to the Australian eSafety Commissioner, who is responsible for enforcing online safety laws and protecting children from cyberbullying, sexual exploitation and abuse. The Commissioner had requested X to answer 12 questions about its policies and practices regarding child abuse content, such as how it detects, removes and reports such content, how it educates and supports its users, and how it cooperates with law enforcement agencies.
However, X failed to respond to the questions by the deadline of October 15, 2023, despite being granted an extension of two weeks. As a result, the Commissioner issued a formal direction to X to comply with the request, which carries a penalty of $100,000 per day for non-compliance. X appealed the direction to the Administrative Appeals Tribunal, but the appeal was dismissed on October 20, 2023. The fine then increased to $600,000 per day from October 21, 2023 onwards, until X complies with the request or reaches the maximum penalty of $10 million.
The Commissioner said that the fine was not intended to punish X, but to compel it to cooperate with the inquiry and ensure the safety of its users, especially children. She said that X had a legal and moral obligation to provide transparent and accurate information about its online safety measures, and that its failure to do so was unacceptable and irresponsible. She also said that the fine was a warning to other social media platforms that they could not ignore or evade their online safety responsibilities in Australia.
X has not commented publicly on the fine or the inquiry, but has reportedly been in contact with the Commissioner’s office to discuss the matter. It is unclear whether X will comply with the request or challenge the fine further. Some experts have suggested that X may be reluctant to disclose its internal processes and algorithms for fear of revealing trade secrets or exposing vulnerabilities. Others have argued that X may be trying to avoid scrutiny or accountability for its role in facilitating or enabling child abuse content.
Whatever the case may be, the fine has drawn attention to the serious and widespread problem of online child abuse content, which affects millions of children around the world. According to a report by the International Centre for Missing and Exploited Children (ICMEC), there were more than 69 million reports of child sexual abuse material (CSAM) in 2019, a 50% increase from 2018. The report also found that CSAM was hosted in more than 150 countries, with Australia being among the top 10 hosting countries.
